Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the PropIQ platform (operated by Property Intelligence Technologies, Inc., “PropIQ,” “we,” “us,” or “our”), including the PropIQ website and mobile app (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, do not use the Services. These Terms apply only to users located in the United States.

Eligibility and Account Creation

You must be at least 18 years old and a U.S. resident to use PropIQ . You agree that all registration information you provide is truthful and accurate. You may access limited features without an account, but to use most of our Services (such as personalized home value tools, preapproval offers, or contacting lenders/contractors) you must register for an account  . When you register, you will provide a valid email address, name, and other required information. You are solely responsible for maintaining the confidentiality of your account login and password  . You accept responsibility for all activities that occur under your account. If you believe your account security has been compromised, you must notify us immediately. Each user may only maintain one PropIQ account.

Services

PropIQ is a real-estate financial services platform. Through our Services, homeowners can discover potential home renovations that may increase property value, and can be connected with lenders (for refinancing, home equity loans, or new financing), licensed contractors, and real estate professionals. We offer tools such as renovation ideas and estimated value impacts, connections to service providers, and prequalification/preapproval for certain financing offers. No Credit Score Impact: Any prequalification or preapproval offered by PropIQ is based on a soft credit check (or other alternative data) and will not affect your credit score. Final loan or service approval is at the discretion of the third-party provider.

Our Services may include both free and paid features. Paid features may require a one-time fee or a subscription (monthly or per-use) as indicated in the Service. By subscribing to a paid feature, you agree to pay the applicable fees and taxes. Fees are non-refundable except as required by law. Affiliate Compensation: PropIQ works with third-party service providers (lenders, contractors, etc.) and may receive referral fees or commissions for successful referrals. Any such compensation does not increase the cost you pay; it is paid by the partner.

User Responsibilities

You agree to use PropIQ lawfully and in good faith. You will provide accurate, current and complete information (such as contact, property, and financial details) and update it as necessary. You must not impersonate others, post unlawful content, spam or harass others, or interfere with the Services. You agree not to evade PropIQ’s tools by redirecting communications outside the Services. Account Security: You are

responsible for keeping your account secure and for all activity under your account  . If you share your password or account access with anyone, that is at your risk. You must notify PropIQ immediately of any unauthorized use of your account.

Data Collection and Use

We collect personal and financial information from you to operate the Services. Personal Information: examples include your name, email, postal address, phone number, property address and details, Social Security Number (SSN), and other identifiers. Financial Information: we may collect income, employment details, credit score and credit report information, loan balances, and related financial data. Usage Information: we may collect data about your use of the Services (e.g. IP address, device/browser data, cookies, and activity logs) to improve and secure the Services  .

You consent to our use of your information as described in our Privacy Policy. In summary, we use your information to:

  • Provide and Maintain the Services: to create your account, verify your identity, and deliver features like

renovation suggestions and financing offers.

  • Personalization: to tailor content and match you with relevant renovation ideas, lenders, or contractors
  • Communications: to send account-related notices, updates, support messages, and marketing communications (you may opt out of promotional emails at any time).
  • Analysis and Improvement: to conduct research, analytics, and improve our algorithms and Services over time.
  • Legal Compliance and Safety: to comply with laws, enforce our Terms, prevent fraud, and protect users and third parties (for example, to detect suspicious activity).

We will not disclose your credit report or score to third parties except as needed to provide Services (e.g. to prequalify you for a loan). Any credit-related activity on your account is done in compliance with the Fair Credit Reporting Act (FCRA); you have rights under the FCRA (e.g. access to a free annual credit report and the right to dispute inaccuracies) .

Third-Party Sharing

PropIQ may share your information with affiliates and trusted third-party service providers to provide and improve our Services. For example, we may provide your information to lenders or loan servicers (so they can evaluate financing options), to contractors (so they can bid on your project), or to real estate agents. These third parties act on our behalf or in partnership with us. We require all partners to protect your data according to our standards and applicable law. We do not sell your personal information to unaffiliated marketers  .

By using PropIQ, you instruct us to share your data with these partners for purposes like eligibility checks, marketing, and personalization. We maintain agreements requiring service providers to use data only for the purpose of providing their services and to keep it confidential. For example, under the Gramm– Leach–Bliley Act (GLBA), we provide notice of information sharing and allow opt-out where required. GLBA Compliance: Financial institutions must notify customers about their data-sharing practices and give them

an opt-out for certain disclosures to nonaffiliated parties. We adhere to these rules, including providing a GLBA privacy notice.

All data sharing is subject to our Privacy Policy, which explains categories of data shared and the controls you have. If you live in California, note that personal financial information subject to GLBA or the FCRA is exempt from the California Consumer Privacy Act (CCPA) requirements.

No Guarantees

PropIQ provides informational tools and connections, but does not guarantee any specific result. We do not promise that any renovation will increase your property value, nor that any financing or services will be approved. Our content and recommendations are for informational purposes only and should not be construed as professional financial or legal advice. Your actual outcomes will depend on many factors. You acknowledge that all decisions are yours alone.

Fees and Affiliate Revenue

Some features of PropIQ may require payment. Subscription plans or service fees will be clearly disclosed before you enroll. All payments must be made in U.S. dollars. We may change our pricing or add new fees, but will notify you in advance. Affiliate Fees: PropIQ has referral relationships with many of the lenders, contractors, and service providers we suggest. If you engage a partner through PropIQ, that provider may pay PropIQ a referral fee or commission. This does not increase the price you pay, but we believe in full transparency.

User Conduct and Termination

You agree to use the Services responsibly. PropIQ reserves the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, fraud, or inactivity  . We may terminate access immediately if required by law or at our discretion. If we terminate for convenience, we may (but are not required to) refund any prepaid fees for unused time. Upon termination, your right to use the Services ends immediately. Sections on intellectual property, disclaimers, limitations of liability, and dispute resolution will survive termination.

Limitation of Liability

Disclaimer of Warranties: THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PropIQ disclaims all warranties, express or implied, regarding the Services, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement  . We do not warrant that the Services will be error- free, uninterrupted, or that any results will be achieved.

No Liability for Damages: TO THE FULLEST EXTENT PERMITTED BY LAW, PropIQ and its affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or use, arising from or relating to the Services  . This includes any claims related to errors or omissions in content, renovation outcomes, contractor or lender actions, third-party services, or unauthorized access to data  . In no event will PropIQ’s total liability exceed the amount you paid us (if any) for the Services during the prior 12 months.

Dispute Resolution; Arbitration

You agree that any dispute, claim or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis. This means you and PropIQ each waive the right to a jury trial and to participate in class actions or representative actions. The Federal Arbitration Act governs the arbitration. The arbitrator’s decision will be final and binding, subject to very limited court review. If for any reason arbitration is not enforceable, any litigation will be in the federal or state courts in New Jersey, U.S.A., and you consent to exclusive jurisdiction and venue there.

Compliance with Laws

PropIQ operates in compliance with applicable U.S. laws. In particular, our Services may involve consumer credit information subject to the Fair Credit Reporting Act (FCRA) and financial privacy laws like the GLBA. We follow all requirements for obtaining and using credit reports (e.g. obtaining your authorization) and for protecting nonpublic personal information. We also comply with the California Consumer Privacy Act (CCPA) and other state privacy laws where applicable. Notably, the CCPA excludes from its scope information protected by the GLBA or FCRA  .

Governing Law

These Terms and your use of PropIQ are governed by the laws of the State of New Jersey, U.S.A. (excluding its choice-of-law rules). If any part of these Terms is held unenforceable, that part will be limited or eliminated to the minimum necessary, with the remaining provisions enforced.
